These Terms constitute a legally binding agreement between you and NiqOut ("we," "us," or "our"). Your continued use of the App or Site after any modifications to these Terms constitutes acceptance of those changes.
NiqOut is a mobile application designed to help individuals quit nicotine use, including vaping and cigarette smoking. Our services include:

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use NiqOut. By using the App, you represent and warrant that you meet this age requirement.
If you are under 18 years of age, you represent that you have obtained parental or guardian consent to use the App.

We reserve the right to terminate accounts that violate these Terms or that have been inactive for an extended period.
NiqOut offers both free and premium subscription tiers. Premium subscriptions provide access to advanced features including personalized AI quit plans, expanded CBT tools, and detailed progress analytics.
Billing. Subscriptions are billed on a recurring basis (monthly or annually) through the applicable app store (Apple App Store or Google Play Store). By subscribing, you authorize recurring charges to your selected payment method.
Free Trials. Where offered, free trials automatically convert to paid subscriptions at the end of the trial period unless cancelled before the trial ends.
Cancellation. You may cancel your subscription at any time through your app store account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused time.
Refunds. All purchases are subject to the refund policies of the applicable app store. We do not independently process refunds for app store purchases.
Price Changes. We may change subscription pricing at any time. We will provide reasonable notice of any price changes before they take effect.

Quitting nicotine can have real physiological effects. If you experience significant withdrawal symptoms, health concerns, or need personalized medical guidance, please consult a qualified healthcare professional.
We are not responsible for any adverse health outcomes arising from your use of or reliance on the App. Results vary and are not guaranteed.
All content within the App and Site — including text, graphics, logos, icons, images, audio clips, and software — is the property of NiqOut or its licensors and is protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial purposes in accordance with these Terms.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from the App without our prior written permission.
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using NiqOut, you consent to our data practices as described in the Privacy Policy.
THE APP AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific results from using the App.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NIQOUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) $10 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
We may suspend or terminate your access to NiqOut at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately.
You may delete your account at any time through the App settings. Sections of these Terms that by their nature should survive termination will do so, including Sections 8, 10, 11, and any others addressing intellectual property, disclaimers, and liability.
We may update these Terms from time to time. When we make material changes, we will notify you via the App or by email. The "Last updated" date at the top of this page reflects the most recent revision.
Your continued use of NiqOut after changes become effective constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the jurisdiction in which NiqOut operates, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by applicable law.
